    I probabably know the answer of this question but would still like to confirm, just to be sure:

    - First I-797B Valid from Jan 2004 to Sep 2006 <- Note: wasn't for 3 years
    - First Visa valid from Jul 2004 to Sep 2006
    - 1st US Entry Date from Aug 2005 till present date
    (been to india in Dec 2007 for 1 month for visa stamping)
    - First i-94 valid from Aug 2005 to Sep 2006


    -Extended I-797A from Sep 2006 to Jan 2009 <-Note: not extended for 3 yrs
    -2nd Visa/I-94 valid from Dec 2007 to Jan 2009

    My questions?

    1. Can my H1B Visa be extended again? This will be my 2nd extension.

    2. Till what Date can be extended?
    a. Jan 2010 (6 yrs from 1st I-797)
    b. Jul 2010 ( 6 yrs from 1st visa stamping)
    c. Aug 2011 (6 yrs from 1st US entry)

    I have a question regarding I-485 finger prints. Can I goto local USCIS office for fingerprints without original FP notice. I have a copy of the FP receipt notice sent by my lawyer by e-mail.

    Hi,

    If u have not recieved ur original fp notice and if lawyer recieved the courtesy copy of ur fp notice,u can take that print and attend ur fp appointment as scheduled.I did not recieve my fp notice by mail,but went and attended successfully my fp appointment with lawyer's copy.Just take passport and ur driver's license for photo identity.(passport only for safe side).

    My wife has already gone to the consulate and got her stamping. So she is out of the loop, its only me who needs the stamp.

    To put my question in a different way:

    Will the consulate cancel/stops/statusquo my wifes H4 visa as the H1B is in "Admin Processing"?

    They will not do it because your visa will be under admin processing and not denied or rejected.

    Is it possible to extend H4 status after using EAD for a person whose I-485 pending in derivative status.

    I read Cronin Memo reg. dual intent "Revision of March 14, 2000 Dual Intent Memorandum"
    It seems to discuss reg. using AP to enter the country and maintaining H status.

    Not sure if anyone here has done the extension of H4 after using EAD.

    Application submitted online - 09/09
    Possible RFE date - 09/10 ( I didn't check)
    9/11 and 9/12 (weekends)
    Supporting document received by USCIS - 9/13 (Morning)

    Checked the status on 09/14/2010 - The current status is - Request for Evidence Response Review

    NC will issue based on H1-B expiry date..if you provide ur AP and EAD, they'll issue only a year or two..hope it helps..

    I planning to use AC 21 from Next week, I plan to call my parents in July 2008, What should I mention as my Immigration Status in Invitation letter.

    As I will not be on H1B and neither I have Green Card ?

    I talked to lot of people about using AC21, nobody is clear.
    Since you confirmly mentioned that you'll invoke AC21 next week, could you inform us as you proceed further in this process. Please remember you are helping the whole community.

    It would be based on your wife's state of origin. If she is from karnataka, kerala, tamilnadu, then she would have to go to chennai. The states that a consulate supports would be listed on their website.

    Yes, you can. Search for 'L2 visa documents' online. The process is similar to B1/B2 ( It was, 2 years ago. Do confirm online).

    Hi All,

    I have used AC21 to switch employers. I also changed attorney using G28.

    Do I need to file G28 for my spouse as well for the new attorney?

    There was a soft LUD on my I-485 on 01/01 and today (01/02). I had applied for my H1 extension sometime back.Will my 485 be touched because of H1 ? My PD is Aug 2006 EB2(obviously cant expect AOS getting processed at this time).

    Any thoughts?

    Since 7 years I was working on EAD and now I am thinking to convert into H1B , since I am planning to get separated from spouse.(my GC process is dependent on my spouse).

    I was not on H1B before.

    Q1: Once I get my H1B, will my EAD gets revoked or can I maintain both H1B as well as EAD?
    Q2: If I get divorced, will by EAD status becomes invalid from the day1 after divorce?

    Recently an undated USCIS draft memorandum surfaced. The Memo was offering administrative relief options to promote family unity, foster economic growth, achieve significant process improvements, and reduce the threat of removal for certain individuals present in the United States without authorization.     Shortly after the memo leaked to the public the Immigration service had this to say:

As a matter of good government, U.S. Citizenship and Immigration Services (USCIS) will discuss just about every issue that comes within the purview of the immigration system. We continue to maintain that comprehensive bipartisan legislation, coupled with smart, effective enforcement, is the only solution to our nation's immigration challenges. Internal memoranda help us do the thinking that leads to important changes; some of them are adopted and others are rejected.     What can we learn from all this? Comprehensive immigration reform may not happen in the near future, but some sort of a step by step change is likely to occur sooner than later. Even USCIS is eager for this to happen, expect more "leaks" coming up.
